Being arrested is a very daunting experience, especially when it’s your first time.  Nonetheless you need to remain calm and remember the following:

  • DON’T ANSWER ANY QUESTIONS (except your name and address) unless you have legal advice or are told by Police that by law you must answer a question.
  • DON’T AGREE TO BE RECORDED (you can refuse to enter the recording room)
  • DON’T SIGN ANYTHING

  • Never be violent, aggressive, offensive, or swear at a Police officer as you will only make things worse. You might not be guilty of anything when they first approach you, but by overreacting, you could be charged with an offence.

If you are being arrested you have a right to silence which generally means you don’t have to answer any questions about what you did or where you were at any time, sign anything, or give an interview.

Police should tell you why they are arresting you and if they dont then you should politely ask them.

If you are arrested, don’t argue or resist.

You do not have to go with Police back to a station unless you are under arrest. If you are in any doubt as to whether you are or are not under arrest you should politely ask Police “Am I under arrest?”

In some cases it is an offence not to answer certain Police questions, usually in relation to vehicles and accidents, and it might be a crime not to answer. If this is the case Police should tell you that if you fail to answer the question you will be committing an offence. However if you are in any doubt you should politely ask “Will I commit an offence if I don’t answer?” Unless they say yes then don’t answer.
